car accident in Oakland

Accident Overview

On April 28, 2016, at 6:22 p.m., our client was driving down Highway 24 eastbound, towards State Route 13 southbound, 3,300 feet east of Broadway in Oakland, California. She was obeying the rules of the road while driving her 2014 Lexus RL350 when another driver hit her causing a serious accident with major damage to the rear of her car. The car accident in Oakland resulted in the loss of work, serious injuries, and large medical bills leaving our client in a state of uncertainty.

About the Car Accident in Oakland

This was a serious two-vehicle accident that resulted in serious injuries for our client due to the other driver’s negligence. The driver of the car that caused the accident was driving a 2006 Accura MDX.

There were no adverse road conditions and the accident happened when the other driver left their lane and entered our client’s lane.

After the accident, our client suffered from a complaint of pain in her head from her head colliding with the driver’s side window. She was transported by Paramedics Plus to Kaiser Permanente in Oakland, where she was treated for a concussion.

The driver of the car that caused the accident was insured by USAA Insurance while our client was insured by Geico Insurance.

Case Facts

Our client needed ongoing medical treatment after the case including cognitive rehabilitation. At first, USAA Insurance questioned whether the forces in the accident were significant enough to cause a concussion.

Our client missed a significant amount of work and was charged large medical bills from this accident.

Based on this information she reached out to GJEL Accident Attorneys to see if she was entitled to compensation and to have her questions answered. She wanted to know:

  1. Who is responsible for my medical bills?
  2. How will I pay these bills and the loss of work?
  3. What if I have permanent lifelong damage to my body?

The staff at GJEL were able to quickly evaluate the case over the phone and the client requested a meeting in the office with managing attorney Andy Gillin.

Based on the serious injuries from this accident and the mounting medical bills, our client decided to retain GJEL Accident Attorneys to help get her life back on track after this tragic accident.

The staff at GJEL started a full investigation which started with getting the police report. The police report showed that the other driver was 100% at fault and responsible for the accident.

At first, the party at fault’s insurance company, USAA, questioned whether the forces in the accident were signification enough to cause a concussion of this magnitude. GJEL attorneys, through their accident reconstruction specialist, were able to demonstrate that the forces were indeed significant enough to cause this post-concussion syndrome.

Attorney Andy Gillin helped our client through this difficult time and ultimately was able to settle this case without litigation. This case took approximately five months to settle without having to file a lawsuit. In the end, our client was awarded $300,000 for this accident after aggressive representation.
