Roundup, a weed killer used in residential and commercial applications, has been found to cause cancer.

In 2015, the International World Health Organization announced their findings that glyphosate-based herbicides, such as Roundup, are most likely carcinogenic.

Types of cancers attributed to this sort of exposure include non-Hodgkin lymphoma and leukemia.

Lawyers for cancer victims have won several jury verdicts finding that the herbicide was a probable cause of their illnesses.

Substantial damages have recently been awarded:

  • $289 million by a San Francisco jury for a Benicia, CA groundskeeper (later reduced by a judge to $78.5 million),
  • $80 million by a jury in San Francisco district for a Sonoma County, CA man, and,
  • More than $2 billion (in punitive damages), by an Oakland jury for a Livermore, CA couple.

Monsanto, the maker of Roundup, insists that its product is safe, however, the U.S. Department of Justice and FDA have found Monsanto guilty of fraudulent Roundup safety testing and falsified results.

At this time, more than 13,000 cases have been filed against Monsanto alleging that exposure to Roundup caused them or their loved ones to develop cancer.

Roundup cancer lawsuits in San Jose will not be class-action lawsuits in which claimants receive only a small, symbolic settlement, because California Roundup lawsuits are being treated as Multi-District Litigation (MDL) in U.S. District Court.

MDL allows similar cases to move forward together, while still preserving the unique details of each case. Each claimant is awarded compensation based on the degree of suffering caused.

Citing “highly-prejudicial” media coverage, Monsanto lawyers have requested that the next round of federal California cases be heard in another state.

For now, the presiding judge overseeing the MDL said he plans to give pending California cases top priority.

If you are considering filing a Roundup cancer lawsuit in the San Jose area, it is important to act quickly.
