A man lost his life after being struck by a vehicle in central Fresno during the early morning hours of Thursday, June 25, 2026. The fatal pedestrian crash occurred just before 12:30 AM at the intersection of Blackstone and Olive Avenues. A driver heading southbound on Blackstone Avenue struck the pedestrian as the vehicle approached Olive Avenue. The injured man was transported to a local hospital, where he was pronounced dead.

The driver remained at the scene, cooperated with investigators, and was not found to be impaired by drugs or alcohol at the time of the crash. The identity of the deceased had not been released as of the time of reporting. The investigation remains ongoing.

Understanding Driver Duties Toward Pedestrians in California

California law imposes a clear duty of care on all drivers to protect pedestrians. Under California Civil Code §1714, every person is responsible for injuries caused by their failure to exercise ordinary care. For motorists, this means a legal obligation to remain vigilant for pedestrians, especially at busy intersections like Blackstone and Olive Avenues.

California Vehicle Code §21950 further requires drivers to yield the right-of-way to pedestrians crossing in a marked or unmarked crosswalk at any intersection. Drivers must slow down and take reasonable precautions to protect pedestrian safety at all times, regardless of the time of day or traffic conditions.

When a collision does occur, California law requires drivers to stop immediately, render reasonable assistance to the injured party, and provide their information to responding authorities. The driver in this case took the important steps of remaining at the scene and cooperating with investigators — actions that reflect a driver’s legal and ethical responsibilities following any collision.

Wrongful Death Claims After a Fatal Pedestrian Accident

When a family loses a loved one in a pedestrian accident, the financial and emotional toll can be devastating. California law provides a path for surviving family members to pursue justice through a wrongful death claim under California Code of Civil Procedure §377.60. Eligible claimants typically include the deceased’s spouse, domestic partner, and children.

A successful wrongful death claim can provide compensation for a range of damages, including:

Economic damages such as medical expenses incurred before death, funeral and burial costs, loss of the deceased’s financial contributions to the household, and the value of household services the deceased would have provided.

Non-economic damages such as the loss of the deceased’s companionship, guidance, love, and moral support.

California’s statute of limitations for wrongful death claims is two years from the date of death under CCP §335.1. Families should act promptly to preserve evidence and protect their legal rights, as critical documentation from the scene, witness accounts, and law enforcement records may become more difficult to obtain as time passes.

Families pursuing a wrongful death claim must also be prepared to demonstrate that the driver’s negligence directly caused the death of their loved one. In California, this means establishing four key elements: that the driver owed a duty of care to the pedestrian, that the driver breached that duty, that the breach caused the fatal injuries, and that surviving family members suffered measurable damages as a result.

Evidence that can strengthen a wrongful death claim includes traffic camera or surveillance footage from the intersection, the official police report, witness statements, medical records, and any toxicology or accident reconstruction findings. The sooner an attorney is retained after a fatal crash, the better the chances of securing and preserving this critical evidence before it is lost or overwritten.

How Wrongful Death Settlement Value Is Calculated

Families often wonder what a wrongful death claim might be worth. California courts and attorneys typically rely on two primary methods to calculate potential settlement value:

The Multiplier Method takes the total economic damages — medical bills, lost income, funeral costs, and similar expenses — and multiplies that figure by a number generally ranging from 1.5 to 5, depending on the severity of the loss, the age of the deceased, and the degree of negligence involved. A higher multiplier is often applied when the loss is particularly catastrophic, or the surviving family members are heavily dependent on the deceased.

The Per Diem Method assigns a specific daily dollar value to non-economic losses suffered by surviving family members — such as grief, loss of companionship, and emotional suffering — and multiplies that daily rate by the number of days the family is expected to endure those losses. This method is especially useful in cases involving younger victims whose absence will be felt across many decades of family life.

Because no two cases are alike, a skilled wrongful death attorney can evaluate the specific facts of your situation and help you understand a realistic range of compensation.

Using a Wrongful Death Settlement Calculator to Estimate Your Claim’s Value

When a family is faced with the sudden loss of a loved one in a fatal pedestrian accident, understanding the potential value of a wrongful death claim can feel overwhelming.

A wrongful death settlement calculator is a practical tool that helps surviving family members begin to estimate the compensation they may be entitled to by factoring in key variables such as the deceased’s age, annual income, life expectancy, medical expenses incurred prior to death, funeral and burial costs, and the non-economic losses suffered by the family.

These include loss of companionship, guidance, and emotional support. While no calculator can predict the exact outcome of a claim, these tools provide a meaningful starting point for families who want to understand the financial scope of their loss before consulting with an attorney.

Because California wrongful death cases involve a complex combination of economic and non-economic damages governed by CCP §377.60 and CCP §377.61, the figures generated by a calculator are best interpreted alongside the guidance of an experienced wrongful death attorney who can account for the specific facts, circumstances, and evidence in your case.

The Importance of an Experienced Pedestrian Accident Attorney

Navigating a wrongful death claim after a fatal pedestrian accident is a complex process. Insurance companies representing at-fault parties often move quickly to minimize their exposure, and families who attempt to negotiate on their own frequently receive far less than they deserve.

An experienced pedestrian accident attorney can conduct an independent investigation, gather surveillance footage, obtain police reports, consult accident reconstruction experts, and build the strongest possible case on behalf of a grieving family. At GJEL Accident Attorneys, our team has spent over 40 years fighting for California accident victims and their families, recovering more than $980 million for our clients.

“The loss of a loved one in a sudden pedestrian accident is a pain no family should have to carry alone, and in the immediate aftermath, it can feel impossible to think about anything beyond grief. But protecting your family’s legal rights in the days and weeks following a fatal crash is one of the most important steps you can take. Evidence disappears, witnesses become harder to reach, and insurance companies begin building their defense long before most families are ready to act. If your loved one was killed at Blackstone and Olive Avenues or anywhere in the Fresno area, I urge you to speak with an experienced pedestrian accident attorney as soon as possible. At GJEL, we will handle every aspect of your case with the care and dedication your family deserves, so you can focus on healing while we fight for the justice and compensation you are owed.” — Andy Gillin, Managing Partner, GJEL Accident Attorneys
