Mission Boulevard and Foothill Boulevard

Mission Boulevard is State Route 238, a state highway running the length of the city from Castro Valley to Union City. It carries volume and truck traffic, the blocks between signals are long, and people cross where they need to rather than walking a quarter mile to a light. Foothill Boulevard runs parallel on the east side and the two meet downtown near B Street, where restaurant, City Hall and BART traffic mix after dark.

Hesperian Boulevard and the west side

Hesperian Boulevard runs north to south past Chabot College, Southland Mall at Winton Avenue and the Kaiser Permanente Hayward Medical Offices. Students, shoppers and patients cross a road built to move cars quickly toward the SR-92 exits. Clawiter Road and Industrial Boulevard nearby carry trucks to the San Mateo Hayward Bridge and the distribution centers.

The walk to BART and the AC Transit stops

Every rider at Hayward BART and South Hayward BART is a pedestrian at both ends of the trip, and so is every AC Transit passenger on Mission, Hesperian and Tennyson. Stops sit on the far side of arterials, riders step out from in front of a stopped bus, and the driver in the next lane never sees them.

School routes and Cal State East Bay

Children walk to school across Harder Road, Winton Avenue, Tennyson Road and Whitman Street. Students cross Carlos Bee Boulevard and Hayward Boulevard on the climb to the Cal State East Bay campus, where the grade shortens sight lines and drivers move faster than the posted limit. A crash involving a child is treated differently by California law and by us, because a young child is not held to an adult standard of care.

What California law requires of drivers in a Hayward crosswalk

Vehicle Code sections 21950 and 21954

Section 21950 requires a driver to yield to a pedestrian crossing in a marked crosswalk or in an unmarked crosswalk at an intersection. Most Hayward intersections have no painted lines, and there is a legal crosswalk at nearly every corner whether or not anyone painted one. Adjusters routinely tell people there was no crosswalk when the law says otherwise. The same section requires drivers to use due care and reduce speed, a duty that does not end when the light turns green.

Section 21954 covers people crossing outside a crosswalk. It says a pedestrian must yield to vehicles close enough to be an immediate hazard. It does not say a driver may run that person down, and it states expressly that drivers still owe a duty of care to everyone on the road.

The jaywalking and dark clothing arguments

Almost every Hayward pedestrian claim opens with the insurer blaming the person who was hit. You were jaywalking. You were in dark clothing at night and the driver could not see you. Neither argument ends a case. California uses pure comparative negligence, so a recovery is reduced by your share of the fault and never wiped out. That is why insurers push fault percentages early, before anyone has measured anything.

Dangerous crossing claims against the City of Hayward or Caltrans

Not every pedestrian crash is only a driver’s fault. A crossing can be built so that a collision is predictable: a ramp that delivers freeway speed into a surface intersection, a signal that allows twelve seconds to cross six lanes, a burned out street light, an obstructed sight line, a crosswalk removed from the place everyone actually walks.

Proving it means obtaining the traffic engineering file, the signal timing sheets, and the prior collision history at that location. Agencies do not volunteer those. The six month claim deadline runs from the date of injury and is the most common way a strong Hayward case is lost before it starts. The police report says I was not in a crosswalk. Is my case over?

No. There is an unmarked crosswalk at most Hayward intersections whether or not lines are painted, and Vehicle Code section 21950 protects you there.
