Accident Overview

On September 22, 2019, at 8:35 p.m., the deceased was driving eastbound on SR-152 in unincorporated Santa Clara County. He was obeying the rules of the road while driving his 1996 Toyota Tacoma when another driver struck our client’s car, causing a severe accident. The accident resulted in the death of our client.

About the Accident

This was a multi-vehicle accident that resulted in death for our client due to the other driver’s negligence. The driver of the vehicle that caused the accident was driving a Big-Rig.

There were no adverse road conditions, and the accident happened when the driver left their lane and entered our client’s lane.

Shortly after the accident, our client was pronounced dead by the coroner. The driver of the car that caused the accident was insured by Network Truck Insurance while our client was insured by Viking Insurance.

Case Facts

Our client left behind a grieving family who did not know where to turn. At first, Network Truck Insurance, through their attorneys, indicated there was only $1,000,000 of insurance coverage. As time went on, it became clear that there was also an umbrella policy with more insurance coverage.

Our client tragically lost his life and left behind a grieving family. Our client also left behind a family without the financial support he had been providing. Based on this information, the family reached out to GJEL Accident Attorneys to see if they were entitled to compensation and to have their questions answered. They wanted to know:

  1. Who is responsible for my medical bills?
  2. How will I pay these bills and the loss of work?
  3. What if I have permanent lifelong damage to my body?

The staff at GJEL were able to quickly evaluate the case and meet with the family.

Based on the death and the mounting debt, our clients decided to retain GJEL Accident Attorneys to help them get back to a semblance of the life they had before.

After two years of litigation and then depth of work GJEL Accident Attorneys was able to make a very substantial recovery for the family and to establish that the other driver was 100% at fault.

Through litigation, GJEL Accident Attorneys learned that there was far more than $1,000,000 in insurance. As the firm continued to collect evidence, the offers got more and more serious.

Attorney Jim Larsen helped our client through this difficult time and ultimately was able to settle this case after extensive litigation. In the end, our client was awarded $2,200,000 for this accident by Network Truck Insurance Company after aggressive representation.
