Auto versus Pedestrian Accident in Unincorporated San Diego County 1

Accident Overview

On July 30, 2016, at 3:10 p.m., our client was pushing his father’s broken-down car (as a pedestrian). This took place on the off-ramp of Interstate 5, Southbound 1.2 miles south of the San Onofre Inspection Facility in unincorporated San Diego County.

About the Accident

This was a vehicle versus pedestrian accident that resulted in serious injuries for our client due to his own negligence in addition to the other driver’s negligence. The driver of the car that caused the accident was driving a 2004 Mitsubishi Galant.

There were no adverse road conditions and the accident happened due to the negligence of both our client and the driver who failed to see his vehicle on the off-ramp.

After the accident, our client suffered from serious back and neck injuries and was taken via ambulance to Scripps Memorial Hospital in La Jolla California.

The driver of the car that caused the accident was insured by Esurance and our client was insured by State Farm Insurance.

Case Facts

Our client needed ongoing medical treatment after the accident. At first, Esurance insurance was not willing to pay for our client’s medical bills and other damages.

Our client missed a significant amount of work and was charged up large medical bills from this accident. Based on this information he reached out to GJEL Accident Attorneys to see if he was entitled to compensation and to have his questions answered. He wanted to know:

  1. Who is responsible for my medical bills?
  2. How will I pay these bills and the loss of work?
  3. What if I have permanent lifelong damage to my body?

The staff at GJEL were able to quickly evaluate the case over the phone, and by talking to the father of our client.

Based on the serious injuries from this accident and the mounting medical bills, our client decided to retain GJEL Accident Attorneys to help get his life back on track after this tragic accident.

The staff at GJEL started a full investigation which started with getting the police report.

At first the partially at fault person’s insurance, Esurance, took the position that the accident was 100% the fault of our client. As the firm continued to collect evidence, it became clear that there was a fault on both parties, and the insurance company agreed to pay their policy limits.

Attorney Andy Gillin helped our client through this difficult time and ultimately was able to settle this case without litigation. This case took approximately six months to settle without having to file a lawsuit. In the end, our client was awarded $100,000 for this accident by Esurance after aggressive representation.
