$100,000 settlement for bicycle accident

Accident Overview

On October 24, 2014, at 12:24 p.m., our client was riding his bicycle eastbound on Scott Blvd. at its intersection with San Tomas Express Way. Our client was obeying the rules of the road while riding his bicycle when another driver hit our client causing a serious bicycle accident. The accident resulted in the loss of work, serious injuries, and large medical bills leaving our client in a state of uncertainty.

About the Accident

This was an automobile versus bicycle accident resulting in serious injuries to our client due to the other driver’s negligence. The driver of the car that caused the accident was driving a 2001 Toyota Camry.

There were no adverse road conditions and the accident happened when the driver left their lane and entered our client’s lane. After the accident, our client had a serious cut to his head as well as scratches on his left arm. He was transported by Rural Metro Ambulance to Valley Medical Center in San Jose where he underwent treatment for these injuries. The driver of the car that caused the accident was insured by Geico Insurance.

Case Facts

Our client needed ongoing medical treatment after the case.

Our client missed a significant amount of work and was charged large medical bills from this accident. Based on this information he reached out to GJEL Accident Attorneys to see if he was entitled to compensation and to have his questions answered. He wanted to know:

  1. Who is responsible for my medical bills?
  2. How will I pay these bills and the loss of work?
  3. What if I have permanent lifelong damage to my body?

The staff at GJEL were able to quickly evaluate the case over the phone and send an attorney to meet our client together with his father.

Based on the serious injuries from this accident and the mounting medical bills, our client decided to retain GJEL Accident Attorneys to help get his life back on track after this tragic accident.

The staff at GJEL started a full investigation which started with getting the police report from the Santa Clara County CHP. The police report showed that the other driver was 80% at fault for the accident.

At first, the party at fault’s insurance company, Geico Insurance, was not convinced of either the proportion of fault on their driver or the extent of the injuries. As the firm continued to collect evidence and obtained an accident reconstruction expert’s opinion, the insurance company agreed to an enhanced settlement before GJEL had to file a lawsuit.

Attorney Andy Gillin helped our client through this difficult time and ultimately was able to settle this case without litigation. This case took approximately five months to settle without having to file a lawsuit. In the end, our client was awarded $100,000 for this accident by Geico Insurance company after aggressive representation.
