A brain injury is the injury nobody at the scene writes down. The Hayward Police Department report lists the vehicle damage and a complaint of pain. The emergency department reads the CT scan, finds no bleeding and sends you home to rest. Four days later you cannot follow a conversation and the light in your own kitchen hurts. Nothing in the file says brain injury, and the adjuster who calls that week is counting on that.

Our Hayward brain injury lawyers handle traumatic brain injury claims that begin on I-880 and SR-92, on Mission Boulevard and Hesperian Boulevard, and on the surface streets around downtown. GJEL Accident Attorneys has done personal injury work and nothing else since 1972, has recovered more than $980 million for clients, and keeps an office at 1728 B St in downtown Hayward. We build these cases with the medicine first, because that is the only way a claim with no visible wound gets paid what it is worth.

How brain injuries happen in Hayward crashes

Almost every brain injury case that reaches our Hayward office starts with a vehicle, and nobody has to strike their head. The brain keeps moving after the skull stops, and that acceleration and deceleration alone tears the connections between brain cells. It is why people walk away from a wreck with an intact helmet and a real injury.

High speed rear end crashes on I-880 and SR-92

Interstate 880, the Nimitz Freeway, runs along the western side of Hayward between Oakland and San Jose, carrying commuters and the freight moving between the Port of Oakland and the South Bay. Traffic compresses and releases at the Industrial Parkway and Tennyson Road interchanges, and a driver who does not slow in time delivers a rear end impact into a car that was fully stopped. Those hits become chain reaction crashes. State Route 92 pours traffic off the San Mateo Hayward Bridge through the Clawiter Road and Hesperian Boulevard exits toward the Jackson Street interchange, and the toll plaza approach produces the same pattern. GJEL has written about a fatal rear end crash on the San Mateo Hayward Bridge and a driver ejected and killed on SR-92 in a crash with a box truck. The warehouse district along Industrial Parkway and Whipple Road puts loaded tractor trailers on those same ramps.

People struck walking and riding on Tennyson Road

When a vehicle strikes a person on foot or on a bicycle, the head meets the hood, the windshield or the pavement, and the brain injury is frequently the most serious part of the case. The Tennyson Road and I-880 interchange is the clearest example in the city. Between 2010 and 2014, four pedestrians and eight bicyclists were struck there. A cyclist was killed in a hit and run at the interchange in October 2016, and a woman walking with her baby was killed there in 2015. In February 2026 a pedestrian was killed and a child critically injured in a Hayward crash. Vehicle Code section 21950 requires drivers to yield to people in marked and unmarked crosswalks at intersections, and that rule is the starting point in most of these claims. See our Hayward pedestrian accident page.

Motorcycle and scooter falls on Mission and Hesperian

Mission Boulevard, which is State Route 238 through Hayward, and Hesperian Boulevard past Chabot College carry motorcycles and, increasingly, electric scooters. A rider cut off in a left turn or squeezed while lane splitting, which is legal under Vehicle Code section 21658.1, has nothing between their head and the pavement but a helmet. Helmets are required under section 27803 and they prevent skull fractures, but a helmet does not stop the brain from moving inside the skull. See our Hayward motorcycle accident page.

Where Hayward brain injury patients are treated

Where you were taken shapes the record your case is built on. Eden Medical Center in Castro Valley is the closest Level II trauma center and takes most of the serious head trauma from Hayward. St. Rose Hospital on Calaroga Avenue has an emergency department and sees a large share of the crashes on city streets. Kaiser Permanente’s Hayward Medical Offices on Hesperian Boulevard carry the outpatient and follow up care, with Kaiser’s San Leandro Medical Center for inpatient admissions. The most severe injuries, the ones needing a neurosurgeon within the hour, go to Highland Hospital in Oakland, the Level I trauma center.

Records from every one of those providers are the backbone of the claim. We gather them and put them in order. If your symptoms are persisting and no one has sent you to a neurologist or a neuropsychologist yet, we will make sure that referral happens, because a gap in the chart is what the insurer uses later.

A normal CT scan does not end the question

What the emergency department scan is looking for

The CT scan run at Eden or St. Rose on the night of the crash asks one urgent question: is there bleeding or swelling that needs surgery right now? It answers that well. It was never designed to detect the microscopic damage behind a concussion or a mild traumatic brain injury, and a normal CT does not rule either one out. Standard MRI often misses them too. The diagnosis rests on symptoms, examination and formal testing, not on a picture.

Symptoms that show up days later

Concussion symptoms commonly appear or worsen in the days after a crash, once a person tries to go back to work, back to class at Cal State East Bay, or back to driving Mission Boulevard at rush hour. Headaches that will not lift. Dizziness. Sensitivity to light and noise. Losing the thread of a sentence. Forgetting appointments. Sleeping badly or constantly. Irritability the people at home notice first. When these last for months, doctors call it post concussion syndrome, and it can end a career. Delayed onset is normal and does not defeat a claim, but it does make it important to get back in front of a doctor and say plainly that you were in a crash. Our guide to concussion injuries covers the medicine in more depth.

The insurance company’s no objective findings argument

The playbook does not vary. The scan was clean, so there is no injury. You did not complain of memory problems for a week, so the two are unrelated. The symptoms come from stress, or age. Adjusters use the phrase no objective findings because a jury will not see a cast or a scar, and they price the claim accordingly.

The answer is evidence. Neuropsychological testing measures memory, processing speed, attention and executive function against normed data, with validity measures showing the person gave genuine effort. It produces exactly the objective findings the insurer says do not exist. Treating physicians explain why a normal CT proves nothing about a concussion, and employment files and performance reviews show the difference between the person before the crash and the person after it.

The other half is the testimony of the people who live with you. A spouse who describes the notes now taped to every door. A supervisor who moved you off a task you used to run. Family members are often the most persuasive witnesses in a brain injury trial, because the injured person is usually the last to see the change. For the same reason we do not let clients give recorded statements to the other side.

What a Hayward brain injury claim has to cover

A claim that counts only the bills on the kitchen table today has already been undervalued. A complete brain injury claim includes:

  • Emergency, surgical, neurological and rehabilitation care already provided.
  • A life care plan: the future treatment, therapy, medication, equipment and attendant care the injury will require, priced across a lifetime by a qualified planner.
  • Lost income and lost earning capacity, the gap between the career you had and the work you can hold now, established through vocational and economic experts.
  • Household services and the unpaid care a spouse, parent or adult child now provides.
  • Pain, suffering, disability and the loss of the life you had, often the largest component and always the most contested.
  • A spouse’s loss of consortium claim.

California puts no cap on these damages outside of medical malpractice, and under pure comparative negligence a share of fault reduces a recovery rather than erasing it. Where the at fault driver carries a minimum policy or none at all, your own uninsured and underinsured motorist coverage under Insurance Code section 11580.2 often becomes the main source of payment. When a head injury is fatal, the family’s case becomes a wrongful death claim under Code of Civil Procedure section 377.60.

Deadlines in a Hayward brain injury case

Two years from the date of injury to file a personal injury lawsuit, under Code of Civil Procedure section 335.1, and two years from the date of death in a wrongful death case. That is the deadline most people have heard of, and it is not the one that catches families.

The six month deadline is. If a public entity had a hand in the crash, a written government claim must be presented within six months under Government Code section 911.2 before any lawsuit is possible. That covers a dangerous crosswalk or roadway maintained by the City of Hayward, Alameda County or Caltrans, and a crash involving a BART or AC Transit vehicle. Six months goes quickly when the injured person is still in rehabilitation. Brain injuries also raise the discovery question, because symptoms are sometimes not diagnosed until months later, but a late discovery argument is a risk nobody should take.

How our Hayward brain injury lawyers build the case

  1. We meet you and your family at home or in the hospital at no cost, and a lawyer, not a case manager, handles the file from the first day.
  2. We get the Hayward Police Department report, or the CHP Hayward Area report if the crash was on I-880, SR-92 or Mission Boulevard.
  3. We preserve the evidence before it disappears: the vehicles, the event data recorders and the camera footage along the corridor.
  4. We make sure you are seen by a neurologist and a neuropsychologist, and we pull the records from Eden, St. Rose, Kaiser and Highland into one chronology.
  5. We retain the experts these cases require: neurologists, neuropsychologists, life care planners, vocational experts and economists.
  6. We find every source of recovery, including umbrella and employer policies behind the at fault driver and your own underinsured motorist coverage, and we handle the medical liens so the money reaches you.
  7. We prepare the case for trial in Alameda County Superior Court, where serious Hayward injury lawsuits are usually heard in Oakland at the René C. Davidson Courthouse. Insurers pay full value to firms they expect to try the case.

Hayward brain injury questions

My CT scan was normal. Do I still have a brain injury claim?

Yes. The emergency department scan looks for bleeding and swelling that needs surgery that night. It is not designed to show the microscopic damage behind a concussion or a mild traumatic brain injury, and standard MRI often misses it too. The diagnosis rests on your symptoms, the examination and neuropsychological testing. A clean scan is the insurer’s favorite argument and it is answered in Alameda County courtrooms regularly.

My symptoms started days after the crash. Does that hurt my case?

Delayed onset is common with brain injuries and it does not defeat a claim. It does make prompt medical follow up important. If you are having headaches, dizziness, memory problems, mood changes or sleep trouble after a Hayward crash, see a doctor now and say you were in a crash, so the connection is in the chart rather than in an argument two years later.

What is neuropsychological testing and why does my case need it?

It is a battery of standardized tests given by a neuropsychologist that measures memory, attention, processing speed and executive function against normed data, with validity measures showing the person gave genuine effort. It turns symptoms that sound subjective into measured results, the direct answer to an adjuster who says there are no objective findings.

How long do I have to file a brain injury claim in Hayward?

Two years from the date of injury under Code of Civil Procedure section 335.1. If a public entity is involved, for example a dangerous crosswalk maintained by the City of Hayward or Caltrans, or a BART or AC Transit vehicle, you have six months to present a government claim under Government Code section 911.2. Camera footage disappears long before either date.

What does a Hayward brain injury lawyer cost?

Nothing up front and nothing unless we win. The fee is a percentage of the recovery, agreed in writing before we start, and the firm advances the cost of the experts a brain injury case requires. The first conversation is free.
