Interstate 880 through Hayward is a freight route first and a commuter route second. Containers move between the Port of Oakland and the South Bay warehouses around the clock, box trucks come off the San Mateo Hayward Bridge on SR-92 all day, and tractor trailers swing into the loading docks on Industrial Parkway. Residents drive the same lanes to work. When a car and an 80,000 pound rig meet at the Tennyson Road or Industrial Parkway interchange, only one of them walks away intact.
Our Hayward truck accident lawyers have been suing motor carriers and their insurers out of this county since 1972, and GJEL has recovered more than $980 million for injured clients. A truck case is where that experience earns its keep, because the carrier’s insurer works the crash while you are still in an emergency room, and the records that show what the driver was doing can be gone within months.

Why a Hayward truck case is not just a bigger car accident case
Three things change the moment a commercial vehicle is involved. The injuries are worse, because of the weight difference and the stopping distance that comes with it. The defendants multiply, because the driver, the carrier, the trailer owner, the crew that loaded it, the broker and the shipper can each carry a share of the blame. And almost all of the proof belongs to the other side.
The electronic logging device, the engine control module, the dispatch messages, the driver qualification file and the post crash drug and alcohol test are the carrier’s property. So is the tractor, which will be repaired and back on I-880 within weeks unless somebody stops it. These cases are won or lost in the first few weeks.
Federal law is the other difference. The Federal Motor Carrier Safety Regulations cap how long a driver can be at the wheel, require electronic logging of those hours, set maintenance duties and require testing after a serious crash. A violation is not a technicality. It is evidence of negligence a jury understands at once, which is why carriers fight to keep their paperwork out of your hands. Our guide to truck driver fatigue and hours of service limits explains how the rules work.
Where truck accidents happen in Hayward
Interstate 880 from A Street to Industrial Parkway
Hayward sits in the middle of the port run between Oakland and San Jose, and the interchanges at A Street, Winton Avenue, Jackson Street, Tennyson Road and Industrial Parkway are where the trouble concentrates. Trucks entering on short merges meet commuters at seventy, and trucks leaving cross two lanes for an exit they nearly missed. In July 2026 a two vehicle crash on southbound I-880 in Hayward sent people to the hospital and drew a CHP response.
SR-92, the bridge approach and the Jackson Street interchange
State Route 92 carries Peninsula traffic across the San Mateo Hayward Bridge and drops it at Industrial Boulevard, Clawiter Road and Hesperian Boulevard before it meets I-880 at Jackson Street. This is delivery fleet country: box trucks, refrigerated vans and contractor rigs, many driven by people behind on a route. In July 2026 an unrestrained driver was ejected and killed on SR-92 in Hayward in a crash with a box truck, and a rear end crash on the bridge in January 2026 killed another person.
The Industrial Parkway and Industrial Boulevard warehouse district
West Hayward is a logistics district. Distribution centers line Industrial Parkway, Industrial Boulevard, Clawiter Road and Whipple Road at the Union City line, with more truck movement around the Hayward Executive Airport. These are the crashes people do not picture: a rig turning wide across a bike lane, a trailer backing out of a dock into a through lane, a load that was never secured before it left the yard.
Mission Boulevard, Foothill Boulevard and the Tennyson corridor
SR-238 is Mission Boulevard, the surface truck route between Castro Valley and Union City, with Foothill Boulevard beside it and the two meeting downtown near B Street. Trucks that leave the freeway to skip a backup end up here, among signals, driveways and people on foot. The Tennyson Road and I-880 interchange is the worst of it: four pedestrians and eight bicyclists were struck there between 2010 and 2014, a woman walking with her baby was killed in 2015, and a cyclist was killed in a hit and run in October 2016.
Underride and chain reaction crashes in stop and go traffic
Traffic on I-880 through Hayward compresses and releases all day, behind the Jackson Street merge, behind the Tennyson Road and Industrial Parkway ramps at shift change, and behind anything at all on the bridge approach. That pattern produces the two crash types that hurt people most.
An underride crash happens when a car slides beneath the side or rear of a trailer. The crumple zones and airbags never get their chance, because the impact arrives at window height. They produce catastrophic head and neck injuries, and deaths in cars that look barely damaged from the front. Rear guards can be missing, corroded or out of compliance, and side guards are not required on most trailers. Our page on what an underride crash is covers the failures we look for.
Chain reaction crashes are the other half. A heavy truck cannot stop in the gap a car can, so it reaches the back of a stopped line and pushes three or four vehicles together. The car in the middle takes hits from both directions, and sorting out the order and the speeds depends on data that has to be preserved right away.
Who can be held responsible for a Hayward truck crash
The driver’s own policy is rarely enough to cover a serious injury, so our first job is to find everyone who shares the responsibility and every policy behind them.
- The driver, for speeding, following too closely, unsafe lane changes, distraction, fatigue or impairment.
- The motor carrier, which answers for its driver’s conduct on the job and for its own hiring, training, dispatch and maintenance. A carrier whose schedule cannot be met inside the hours of service limits is directly on the hook.
- The broker and the shipper, when they picked a carrier with a poor safety rating or set a delivery window that could only be met by breaking federal rules.
- The warehouse or loading company, when a shifted, overweight or unsecured load caused the crash. In a district built on loading docks, that comes up often.
- Maintenance contractors and parts makers, when brakes, tires, lighting, coupling hardware or an underride guard failed.
- A public agency, when road design, signage or a work zone contributed. A claim against Caltrans, the City of Hayward or Alameda County must be presented within six months under Government Code section 911.2.
Interstate carriers must carry at least $750,000 in liability coverage and most carry more, often in layers, with umbrella policies above the primary one and separate coverage held by the broker and the shipper. Finding all of it is part of the work.
The evidence the carrier controls, and how fast it disappears
Within days of taking a Hayward truck case we send a preservation letter to the carrier, the broker and their insurers. It demands that specific records be kept, and it removes any later claim that a document was destroyed innocently:
- Electronic logging device data and hours of service records, which carriers need only keep for six months.
- The engine control module download and any forward facing or cab camera footage, which shows speed, braking and following distance.
- The driver qualification file, medical certificate, training records and prior violations.
- Post crash drug and alcohol test results, required by federal rules after a fatality or a tow away with injuries.
- Dispatch records and messages, bills of lading, weight tickets and the broker’s carrier selection file.
- Inspection, repair and maintenance records for the tractor and the trailer, including the underride guard.
We move just as fast on the evidence outside the carrier’s control: the traffic collision report, camera footage from the warehouses along Industrial Parkway and Clawiter Road, witness contact information before it goes cold, and the data recorder in your own vehicle before the insurer sends it to salvage. The California Highway Patrol’s Hayward Area office investigates I-880, SR-92 and Mission Boulevard, and the Hayward Police Department handles city streets.
What to do in the first days after a Hayward truck accident
- Get treated, and keep going back. Eden Medical Center in Castro Valley is the closest Level II trauma center, St. Rose Hospital on Calaroga Avenue has an emergency department, and the worst injuries go to Highland Hospital in Oakland. Kaiser’s Hayward Medical Offices on Hesperian Boulevard handle follow up care. A gap in treatment is the first thing an adjuster uses against you.
- Make sure a report exists, and note which agency wrote it: CHP for the freeways and Mission Boulevard, Hayward PD for city streets.
- Photograph the tractor, the trailer, the company name and the USDOT number on the door. That number identifies the carrier and its safety history even when nobody at the scene is straight with you.
- Say nothing recorded to the trucking company’s insurer and sign nothing it sends you. The adjuster’s job is to lock in a version of events that limits what the carrier pays.
- Do not let your vehicle be salvaged. It holds crash data and physical evidence an expert needs to inspect first.
- Call a lawyer while the truck is still in service and the logs still exist. The two year filing deadline is not the urgent clock. The evidence is.
What a Hayward truck claim is worth, and the deadlines that limit it
Truck crashes produce the injuries that reorganize a family’s life: traumatic brain injury, spinal cord damage and paralysis, crush injuries and amputations, burns and internal bleeding. A claim built properly covers the hospital care, the surgeries and rehabilitation, the future costs set out in a life care plan, lost income and lost earning capacity, home and vehicle modifications, attendant care, and the pain and disability no invoice measures. Where a carrier knowingly kept an exhausted or unfit driver on the road, punitive damages come into play. When a crash is fatal, the family’s claim runs through our Hayward wrongful death lawyers.
Be careful with the brain injury piece. A normal CT scan does not rule out a concussion, symptoms often surface days later, and the insurer will argue that anything invisible on imaging did not happen. Our Hayward brain injury lawyers answer that with treating physicians and neuropsychological testing.
California allows two years from the date of injury to file suit under Code of Civil Procedure section 335.1, and two years from the date of death in a wrongful death case. If a public entity is involved, the six month claim under Government Code section 911.2 comes first. Our verdicts and settlements show what these claims are worth.
How our Hayward truck accident lawyers build the case

A lawyer takes your case from the first conversation, not a case manager. We meet you at home or at your hospital bed if you cannot reach the office on B Street, and we have Spanish speaking staff. We send the preservation letters, get the tractor and trailer inspected before they return to service, bring in reconstruction and trucking safety experts early, identify every carrier, broker, shipper and policy in the chain, and manage your medical liens. We prepare the case for an Alameda County jury from day one, which is the only reason a carrier’s insurer ever pays full value.
You owe nothing up front. Our fee is a contingency fee agreed in writing, we advance the cost of the experts and the investigation, and if we do not recover money there is no fee. GJEL has practiced personal injury law and nothing else since 1972, with more than $980 million recovered, a 99 percent success rate and recognition in Best Lawyers in America. Hayward truck accident questions
How long do I have to file a truck accident claim in Hayward?
Two years from the date of the crash to sue the driver and the motor carrier, under Code of Civil Procedure section 335.1. Six months to present a claim if Caltrans, the City of Hayward or Alameda County is involved, under Government Code section 911.2. Neither is the deadline that decides your case. Hours of service records only have to be kept for six months, and the truck is back on the road long before that.
Who investigates a truck crash on I-880 or SR-92 in Hayward?
The California Highway Patrol’s Hayward Area office covers I-880, SR-92 and Mission Boulevard, and CHP officers with commercial vehicle training often inspect the truck at the scene. The Hayward Police Department investigates city streets, including the warehouse routes on Industrial Parkway. We request the report, the officer’s notes, any inspection paperwork and the scene photographs.
The trucking company’s insurer already called me. Should I talk to them?
Take the adjuster’s name, company and claim number, then decline to give a recorded statement until you have spoken with a lawyer. A call within a day of the crash is evidence gathering, and what you say will be quoted back to you a year later.
What if the truck driver says I stopped short in front of him?
That is the standard defense in a stop and go freeway crash. California uses pure comparative negligence, so even if a jury assigns you part of the fault, your recovery is reduced by that share rather than eliminated. In practice the truck’s own data contradicts the driver, because speed, following distance and braking are all recorded. That is why it has to be preserved early.
