Auto versus Pedestrian Accident 1

Accident Overview

On March 9, 2016, at 7:30 a.m., our client was in a marked crosswalk on Beacon Avenue at its intersection with State Street in the city of Fremont, county of Alameda, state of California. Our client was legally in the crosswalk when another driver struck our client smashing him to the pavement. The accident resulted in the loss of work, serious injuries, and large medical bills leaving our client in a state of uncertainty.

About the Car vs. Pedestrian Accident

This was an auto versus pedestrian accident that resulted in serious injuries. The driver of the car that caused the accident was driving a 2009 Toyota Prius. There were no adverse road conditions.

After the accident, our client suffered significant back injuries, neck, and arm injuries as a direct result of the accident. Our client was taken by Paramedics Plus Ambulance to Washington Township Hospital where he underwent treatment for his back, neck, and leg injuries. The driver of the car that caused the accident was insured by Progressive Insurance.

Case Facts

Initially, the auto insurance company for the party at fault questioned the amount of damages and questioned who was at fault. Our client missed a significant amount of work and was charged large medical bills from this accident.

Based on this information, he reached out to GJEL Accident Attorneys to see if he was entitled to compensation and to have his questions answered. He wanted to know:

  1. Who is responsible for my medical bills?
  2. How will I pay these bills and the loss of work?
  3. What if I have permanent lifelong damage to my body?

The staff at GJEL were able to quickly evaluate the case over the phone and arrange to meet the client at Washington Hospital.

Based on the serious injuries from this accident and the mounting medical bills, our client decided to retain GJEL Accident Attorneys to help get his life back on track after this tragic accident.

The staff at GJEL started a full investigation which started with getting the police report from the Fremont California Police Department. The police report showed that the other driver was 100% at fault and responsible for the accident.

Once GJEL obtained the police photographs, our private investigator was able to establish that the other driver was 100% at fault and responsible.

At first, the other party’s insurance company, Progressive Insurance, was not convinced that their driver was at fault. As the case progressed, and with the help of GJEL Accident Attorneys, Progressive Insurance agreed to settle the case.

Attorney Andy Gillin helped our client through this difficult time and ultimately was able to settle this case without litigation. This case took approximately eleven months to settle. In the end, our client was awarded $175,000 for this accident by Progressive Insurance after aggressive representation by GJEL.
