Motorcyclist Splitting Lanes in Unincorporated Alameda County 1

Accident Overview

On October 8, 2018, at 7:35 p.m., our client was driving his 2013 Honda Motorcycle on interstate 580 eastbound 0.62 miles west of Grant Line Road in unincorporated Alameda County. He was driving the speed limit and he was driving carefully, however, he was floating lanes. Another driver in a 2007 Toyota Camry cut in front of our client resulting in a collision. Splitting lanes in California is legal, and our client was obeying the rules of the road. The accident resulted in the loss of work, serious injuries, and large medical bills leaving our client in a state of uncertainty.

About the Accident

This was a vehicle versus motorcycle accident that resulted in serious injuries for our client due to the other driver’s negligence. The driver of the car that caused the accident was driving a 2007 Toyota Camry.

There were no adverse road conditions when the accident happened.

After the accident, our client suffered from a severe back injury and was transported via ambulance to Eden Hospital in Alameda County. The driver of the car that caused the accident was insured by AAA Insurance while our client’s motorcycle was insured by Geico Insurance.

Case Facts

Our client needed ongoing medical treatment after the case including physical therapy. At first, AAA Insurance contended our client was at fault for splitting lanes. For that reason, the insurance company was not convinced that our firm would prevail at trial in this case.

Our client missed a significant amount of work and was charged large medical bills from this accident. Based on this information, he reached out to GJEL Accident Attorneys to see if he was entitled to compensation and to have his questions answered. He wanted to know:

  1. Who is responsible for my medical bills?
  2. How will I pay these bills and the loss of work?
  3. What if I have permanent lifelong damage to my body?

The staff at GJEL were able to quickly evaluate the case over the phone and invited our client into the office to meet us regarding his case.

Based on the serious injuries from this accident and the mounting medical bills, our client decided to retain GJEL Accident Attorneys to help get his life back on track after this tragic accident.

The staff at GJEL started a full investigation which started with getting the police report.

At first, the party at fault’s insurance company, AAA Insurance was not taking full responsibility for the damages caused by the wrongdoer and offered an amount that neither our client nor GJEL Accident Attorneys was willing to accept.

Attorney Andy Gillin helped our client through this difficult time and ultimately was able to settle this case without litigation. This case took approximately six months to settle without having to file a lawsuit. In the end, our client was awarded $100,000 for this accident by AAA Insurance company after aggressive representation.
